Terms of service

General Terms and Conditions (GTC)

1. General

Version date: 18 June 2026

1.1.

These General Terms and Conditions ("GTC") apply to orders, sales and deliveries of products ("Products") offered and sold in this online shop ("Shop") via the website https://www.federicatabarretti.com/

1.2.

The language of contract is German.

2. Scope of Application

2.1.

These GTC apply when the buyer is a consumer within the meaning of § 1 of the Austrian Consumer Protection Act (KSchG) ("Customer").

3. Amendments to the GTC

3.1.

The provider reserves the right to amend these GTC. The GTC in force at the time of purchase shall apply to the sale of products.

4. Customer Account

4.1.

To place orders, the customer may create a customer account in the Shop. Creating an account requires the customer to provide certain information.

Orders can also be placed without a customer account.

5. Order, Order Confirmation, Shipping Confirmation

5.1.

The ordering process consists of the following steps:

  • Selection of the desired goods
  • Adding goods to the shopping cart
  • Entry of personal details
  • Selection of payment method and delivery method
  • Review and, if necessary, correction of the order
  • Binding submission of the order by clicking "Order with obligation to pay"

5.2.

The products and prices displayed in the Shop constitute an invitation to the customer to submit a binding offer to purchase the products ("Order"). By clicking the button labelled "Order with obligation to pay" or equivalent wording, the customer submits a binding order to the provider. Images and illustrations of goods are approximate values only, unless explicitly stated as fixed values in the product description. The customer accepts minor and factually justified deviations.

5.3.

The provider will promptly send the customer a confirmation to the e-mail address provided, confirming receipt of the order ("Order Confirmation"). This Order Confirmation does not constitute acceptance of the customer's order, but merely confirms that the order has been received.

5.4.

Acceptance takes place at different times and in different forms depending on the chosen payment method:

  • By sending an order confirmation by e-mail, whereby the time of receipt by the customer is decisive.
  • By dispatching the ordered goods to the customer, whereby a shipping confirmation shall be deemed an order confirmation. If no separate shipping confirmation is sent, receipt of the goods by the customer is decisive.
  • By sending a payment request.

5.5.

The customer must ensure that all information provided in connection with an order, in particular the data required for shipping, is accurate, correct and up to date. The customer must notify the provider of any changes to this information without delay.

6. Payment

6.1.

All prices are stated in Euro including VAT, but excluding shipping costs, unless otherwise indicated. Shipping costs will be displayed to the customer before placing the order.

6.2.

Payment in the Shop can be made using the following methods: credit card, Apple Pay, PayPal, instant bank transfer, Google Pay.

6.3.

Shipping costs depend on the order and will be shown by the provider before the order is placed and in the order confirmation.

7. Delivery

7.1.

The customer may choose from the shipping options offered by the provider in the Shop.

7.2.

Delivery dates provided by the provider are based on information from the appointed shipping service provider. Unless a different delivery date is specified for a particular product, delivery shall take place within a maximum of 10 days from conclusion of contract.

7.3.

If failure to meet the delivery date is due to force majeure, industrial action or other events outside the provider's control, the delivery date shall be extended appropriately for the duration of the obstacle. The provider will notify the customer of the beginning and end of such circumstances as soon as possible; the customer may not derive any claims from failure to provide such notification.

7.4.

If the customer defaults on acceptance of the products, the warranty period for the provider's performance shall begin to run.

7.5.

If the customer opts for self-collection, the provider will notify the customer by e-mail that the ordered goods are ready for collection. After receiving this e-mail, the customer may collect the goods from the provider's premises by prior arrangement. No shipping costs apply for self-collection.

7.6. International Deliveries / Customs and Import Duties

For deliveries to Switzerland and the United Kingdom, all displayed prices are net prices excluding local VAT and customs duties. Any applicable import charges (local VAT and customs duties) will be collected directly by the respective customs authority from the recipient. The buyer is responsible for the payment of these charges. Returns due to unpaid customs duties are at the buyer's expense.

For returns from Switzerland and the United Kingdom, the customer bears all shipping and customs costs, including any re-import duties.

8. Retention of Title

8.1.

The provider retains ownership of the products until full payment of the purchase price and ancillary costs (in particular shipping costs) by the customer.

9. Default by the Provider

9.1.

If the provider defaults on performance, the customer must first request the provider to perform within a reasonable grace period of two weeks. If the provider fails to perform within this period, the customer may withdraw from the contract or continue to demand performance.

10. Warranty

10.1.

Federica Tabarretti provides warranty in accordance with the applicable statutory provisions. For complaints, please contact info@federicatabarretti.com.

10.2.

The provider may request that the customer, where reasonably practicable, return the defective products, with the provider bearing the risk of return shipment and the costs thereof. The customer is requested to report any obvious transport damage to the delivery service and to inform the provider accordingly. Failure to do so shall have no effect on the customer's warranty claims.

11. Liability and Damages

11.1.

The provider's liability for damages caused by slight negligence, with the exception of personal injury and core contractual obligations, is excluded. Liability is also excluded for pure financial loss, loss of profit, third-party damages, indirect damages and consequential damages. The liability-limiting or excluding provisions of this clause 11 do not apply to the extent that gross negligence or wilful misconduct on the part of the provider is established.

12. General Provisions

12.1.

Unless Austrian law already applies due to the orientation of this Shop towards Austria, the exclusive application of Austrian law is agreed, to the exclusion of the UN Convention on Contracts for the International Sale of Goods (CISG).

12.2.

In the case of consumers, this choice of law applies only to the extent that the protection afforded by mandatory provisions of the law of the country in which the consumer has their habitual residence is not thereby withdrawn.

12.3.

The customer may only offset claims against the provider's claims if the claims are legally related, have been acknowledged, or have been established by a court.

12.4.

The customer is obliged to notify the provider of any change of address. If the customer fails to do so, any declaration sent by the provider to the last known address shall nonetheless be deemed to have been received.

Lapse of Right of Withdrawal

The right of withdrawal lapses for goods delivered in sealed packaging which are not suitable for return for reasons of health protection or hygiene, if the seal has been broken after delivery.

The right of withdrawal lapses for audio or video recordings such as CDs, DVDs, etc., and for computer software delivered in sealed packaging, if the seal has been broken after delivery.

The right of withdrawal lapses for goods which, by their nature, have been inseparably mixed with other goods after delivery.

Right of Withdrawal

You have the right to withdraw from this contract within fourteen days without giving any reason.

Consequences of Withdrawal

We will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of such reimbursement.

We may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent back the goods, whichever is the earliest. Reimbursement will be made without undue delay, and not later than fourteen days after we receive the returned goods.

You shall send back the goods or hand them over to us at:

You will have to bear the direct cost of returning the goods.

You are only liable for any diminished value of the goods resulting from the handling other than what is necessary to establish the nature, characteristics and functioning of the goods.
